Terms of Service

For plan package details and services provided by Indiaregisters.com, please refer to the website as the most valid reference. Any commitment made by our employees over chat/phone/mail or by any other mode, which is not mentioned on our website, will not be abided.
 

Server Use

Personal, Professional and Business packages are to be used by the primary owner only. Personal, Professional and Business package holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Customers may however resell our Reseller packages.

Indiaregisters.com reserves the right to refuse service and /or access to its servers to anyone.
 

Indiaregisters.com do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lead or obscene content.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Email

INDIAREGISTERS.COM has a STRONG anti-spam policy and applies it. Spammers are NOT welcomed. This includes spamming through open proxy servers or any other kind of unsolicited email advertising. If a customer is found to be in violation of our SPAM policy, INDIAREGISTERS.COM. may, at its sole discretion, restrict, suspend or terminate customer's account. Further, INDIAREGISTERS.COM reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. INDIAREGISTERS.COM will notify law enforcement officials if the violation is believed to be a criminal offense. The customer acknowledges that he is responsible for any and all SPAM related actions which come from their account.


Sending unsolicited email messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited even if the lists are said to be opt-in.
Customer will not use another site's mail server to relay mail without the express permission of the site.
It is strictly forbidden to send out unsolicited email from any other network that advertises, promotes or in any way points to a location inside INDIAREGISTERS.COM network.
 

Unlimited Use Policy

High bandwidth usage: Indiaregisters.com offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, Indiaregisters.com may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, Indiaregisters.com reserves the right to impose the High Resource User Policy for the consideration of all customers.
 

High Resource User Policy

Resources are defined as bandwidth and/or processor utilization.

Indiaregisters.com may implement the following policy to its sole discretion:
When a website is found to be monopolizing the resources available Indiaregisters.com reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Indiaregisters.com continues hosting the website for an additional fee.
 

Payment Policies

All accounts are set up on a prepay basis. Although Indiaregisters.com reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's  will be charged.

All payment are to be made in Indian rupees only.
 

Designing

Client should provide his Content or Images after the week of Billing date. If it exceeds from Billing date it is treated as new order. Money cannot be refunded for the Design order.
Minor Changes like spelling mistake and alignments can be done for the 1 Month of the Billing Date.
The Content placed on the website is completely responsible should be taken by client.

Payment Options

In order to streamline our accounting procedures and keep costs down Indiaregisters.com runs a limited number of payment options.

Cash - Indiaregisters.com accepts cash only at their Hyderabad office.

Cheque or DD Payment - This option is available to customers who pay annually for their Indiaregisters.com account. Indiaregisters.com cannot guarantee that a service will be provided until after any received cheques or DD's have been cleared.

Default Of Payment - As consideration for the domain name registration services and/or other services provided by Indiaregisters.com to you, you agree to pay Indiaregisters.com, prior to the effectiveness of the desired domain name registration, the applicable service(s) fees for the initial registration of the domain name and, should you choose to renew the registration, subsequent renewals of the registration. All fees are non-refundable, in whole or in part, even if your domain name registration is suspended, cancelled or transferred prior to the end of your then current registration term. Your requested domain name will not be registered unless we receive actual payment of the registration fee, or reasonable assurance of payment of the registration fee from some other entity (such reasonable assurance as determined by Indiaregisters.com in its sole discretion). As further consideration for the Indiaregisters.com service(s), you agree to: (1) provide certain current, complete and accurate information about you as required by the registration process and (2) maintain and update this information as needed to keep it current, complete and accurate. All such information shall be referred to as account information ("Account Information"). In the event of a charge back by a credit card company or Cheque or DD (or similar action by another payment provider allowed by us) in connection with the payments of the registration fee for your domain name registration, you agree and acknowledge that the domain name registration shall be transferred to Indiaregisters.com as the paying entity for that registration to the registry. We will reinstate your domain name registration solely at our discretion, and subject to our receipt of the initial registration or renewal fee and our then-current reinstatement fee, currently set at Rs.1000.00. You will be notified via an email message or via your account information when renewal fees are due. Should these fees go unpaid within the time specified in a second notice or reminder regarding renewal, your registration will be cancelled. Payment must be made by credit card or such other method as we may indicate in the registration application or renewal form. We will renew your name for you provided your credit card or other billing information is available and up to date, unless you instruct us otherwise within the time specified. If your billing information is not accurate and you wish to renew your domain name registration, we will contact you to update this information and charge you accordingly.
 

Cancellation & Refunds

Indiaregisters.com reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes Indiaregisters.com' terms of service a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time. During the initial trial period customers who wish to cancel will be entitled to a full refund for their hosting fees. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.

Fees charged on a prepay basis are non-refundable. Once the initial trial period has expired customers are not entitled to receive a refund unless the service is cancelled by Indiaregisters.com. In addition some accounts incur set-up fees, these charges are also non-refundable.
 

Expiry And Renewal Of Services:

EXPIRATION AND RENEWAL OF SERVICE (S): You acknowledge that it is your responsibility to keep your own records and to maintain your own reminders regarding when your domain name registration or other Services are set to expire. As a convenience to you, and not as a binding commitment, we and/or your Primary Service Provider may notify you via an email message or via your account when renewal fees are due. Should these fees go unpaid, your Services will expire or be cancelled. You acknowledge that it is your responsibility to keep your billing information up to date and that we are not required to, but that we may, contact you to update this information in the event that an attempted transaction is not processed successfully. *please note: for certain TLDs, the automatic renewal option is not available|
Indiaregisters.com cannot be held responsible for the content on your site or the domain ownership once the domain is expired.
Even if grace period is applied for 20 days for renewal Indiaregisters.com will not guarantee or bind for the domain renewal once the domain is expired.
 

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Indiaregisters.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Indiaregisters.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Indiaregisters.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Indiaregisters.com' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Indiaregisters.com' server.
 

Disclaimer

Indiaregisters.com will not be responsible for any damages your business may suffer. Indiaregisters.com makes no warranties of any kind, expressed or implied for services we provide. Indiaregisters.com disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Indiaregisters.com and its employees. Indiaregisters.com reserves the right to revise its policies at any time.
